Verdicts and Settlements

Our attorneys have tried to verdict or settled hundreds of cases.  Each case is important to the firm.  The following are some of the verdicts or settlements obtained by our attorneys.

$23.5 Million settlement of a class action against HSBC Card Services relating to the bank’s credit cards. alleging that the bank imposed payment protection without consent , deceptively marketed the service, and improperly administered the plan harming consumers (Bryan H. Mintz, with co-counsel, Eastern District of Pennsylvania, 2013).

$21 million verdict, Child Services Negligence-inflicted damages upon a child in foster care. Infant child was improperly placed in foster care and was abused suffering “shaken baby syndrome” resulting in brain damage and multiple bone fractures. State was held liable for breaching its own procedures and regulations in child placement and required oversight. Foster parents were held jointly liable for the inflicted physical damage. $20 Million settlement of a class action against Bank of America relating to the bank’s credit cards. alleging that the bank imposed payment protection without consent , deceptively marketed the service, and improperly administered the plan harming consumers (Bryan H. Mintz, with co-counsel, Northern District of California, 2013).

$10 Million settlement of a class action against Discover Financial Services relating to the bank’s credit cards. alleging that the bank imposed payment protection without consent , deceptively marketed the service, and improperly administered the plan harming consumers (Bryan H. Mintz, with co-counsel, Northern District of Illinois, 2013).

$6 Million settlement of a class action against Discover Financial Services related to its merchant membership program and the allegation that the bank was charging merchants for the program without authorization (Bryan H. Mintz, with co-counsel, Southern District of Florida), 2011).

$4.2 Million settlement of a class action against American Traffic Systems, Inc. and 18 New Jersey municipalities alleging a failure to comply with New Jersey laws governing red light cameras. (Bryan H. Mintz, with co-counsel, District of New Jersey, 2013).

$4.1 million settlement involving a construction accident with a related defective product case. (with co-counsel, Essex County, New Jersey).

$3 million pre-trial mediated settlement, Medical Malpractice against a major New York medical center, negligent performance of a diagnostic medical procedure that caused a stroke and partial paralysis in a 50 year old woman. (Jeffrey E. Strauss, New York County-Manhattan, NY) (2013).

$3 million settlement, Medical Malpractice, failure to use noninvasive methods to investigate an urgent vascular condition resulting in an invasive catheterization and a stroke in a 29 year old woman. (Jeffrey E. Strauss, Co-Counsel, Rockland County, NY)(2006).

$2.45 million pre-trial mediated settlement, sexual abuse of high school student by a teacher, disease transmission & emotional injury. (Jeffrey E. Strauss, Essex County 2010).

$2.1 Million settlement of a class action against Redflex and 5 municipalities alleging a failure to comply with New Jersey laws governing red light cameras. (Bryan H. Mintz, with co-counsel, District of New Jersey, 2014).

$1,986,475 settlement involving serious injuries arising out of an automobile accident. (Union County 2010).

$1.7 million settlement, Medical Malpractice in failing to timely diagnose, refer and treat a patient with cardiac symptoms resulting in a heart attack and severe heart muscle damage. (Jeffrey E. Strauss, Bergen County, New Jersey 2004).

$1,475,000 settlement arising out of a motor vehicle accident. (Bergen County, 2015).

$1 million settlement, Medical Malpractice in a neurosurgical operation that caused paralysis. (Insurance policy limits)(Jeffrey E. Strauss, Essex County 2010).

$850,000 settlement involving a fall from scaffolding work injury. (Essex County, New Jersey 2015).

$850,000 settlement, Auto Accident, Injuries included Fibromyalgia & Chronic Fatigue Syndrome that caused early retirement as a Librarian. (Jeffrey E. Strauss, Essex County 2005).

$775,000 settlement arising out of trench collapse during sewer construction. (Burlington County, New Jersey 2006).

$725,000 settlement, Truck-Pedestrian accident, Pedestrian crossing street was hit by a construction truck resulting in loss of smell and orthopedic injuries. (Jeffrey E. Strauss, Union County 2011).

$650,000 settlement, Medical Malpractice, failing to timely diagnose and refer for treatment a middle age high risk male patient for treatment of cardiac symptoms substantially contributing to the necessity of a heart transplant. (Jeffrey E. Strauss, Morris County 2005).

$650,000 settlement, Medical Malpractice, Surgical error in which the Orthopedic Surgeon cut one of the ligaments during a knee operation on a 25 year old man. Settled just before trial. (Jeffrey E. Strauss, Union County 2011).

$625,000 settlement involving a machine products defect at a Middlesex County factory. (Middlesex County, New Jersey 2006).

$550,000 settlement of wrongful death and survivorship case brought by widow of a man fatally injured by a falling tree limb (Morris County, New Jersey 2009).

$500,000 settlement in a premises liability matter. (Essex County, New Jersey 2012).

$500,000 settlement during trial, Product Liability-Consumer Product Defect, commonly used type of sponge mop recoiled with such force that the retracting slide caught the users’ wedding band causing it to slice into the ring finger joint amputating the finger. $460,000 settlement for bite and scar injuries to hand and wrist, 16 year old female plaintiff was visiting a county operated zoo when a prairie dog known to have bitten two other visitors in the preceding two weeks leaped and bit her wrist causing permanent scarring and loss of function. These verdicts and settlements are actual cases. Each case is different. The facts, the law, the age of the injured person, the severity of the injury, the makeup of the jury, the rulings of the judge, are some of the factors that make each case different.
